Accordingly, Circular No. 38/2023/TT-BCT regulates techniques for measuring, reporting, and appraising greenhouse gas emission mitigation and guides greenhouse gas inventory (GGI) for industry and trade sectors such as steel, energy, coal mining. Circular No. 38/2023/TT-BCT takes effect February 11, 2024.
Regarding organization and implementation, the Ministry of Industry and Trade assigns the Department of Energy Saving and Sustainable Development to be responsible for guiding, inspecting and supervising the implementation of this Circular. When legal documents referenced and applied in this Circular are amended, supplemented or replaced, the new regulations will apply.
This will be the most detailed circular guiding on greenhouse gas inventory for the steel, energy, thermal power, and coal mining industries of the Industry and Trade Sector after Decree 06/2022 and Decision 01/2022 on the list Units must conduct a Greenhouse Gas inventory.
Notably in this circular, the Ministry of Industry and Trade currently only requires units of the industry and trade sector to conduct greenhouse gas inventories in 2 scopes including Scope 1 (Direct emission scope). and scope 02 (Indirect emissions scope). The Ministry of Industry and Trade does not mention emission scope 03 - indirect emissions, which is specified in the ISO 14064 standard.

Principles for conducting GGI inventory and appraising GGI emission mitigation at sector level

The field-level greenhouse gas inventory process of the Industry and Trade sector is specifically regulated as follows:
The scope of GGI inventory carried out in the energy sector, industrial processes and product use in the Industry and Trade sector has been specifically stated in the circular. The parties in charge of the GGI inventory carry out quality control of the GHG inventory. The steps in the process of conducting a GGI inventory have been specifically guided by the Ministry of Industry and Trade in section 1, chapter II of the guiding circular. The implementation of greenhouse gas inventory at the grassroots level in the Industry and Trade sector is specified in detail in Section 2, Chapter II.

The Ministry of Construction has also developed draft guidance on GHG inventory and MRV to mitigate GHG emissions for construction materials production, expected to be issued soon. At the same time, the Ministry of Construction is also researching and developing a Plan to reduce GHG emissions in the management sector of the Construction industry, expected to be issued in 2024.
Along with that, the Ministry of Transport has submitted to the Prime Minister to promulgate an Action Program on green energy conversion, reducing carbon and methanol emissions of the Transport sector.
Previously, in early 2023, the Ministry of Natural Resources and Environment also issued Circular No. 17/2022-BTNMT guiding Greenhouse Gas inventory for the waste management sector.
